Rules for buying, selling and returning goods
General provisions:
1.1 The MV Fashion Gallery online store rules (hereinafter referred to as the Rules) are a legally binding document for the Buyer and the Seller (hereinafter referred to as the online store), which establishes the rights and obligations of the Parties.
1.2. The online store reserves the right to change, amend or supplement these Rules at any time. The Buyer is informed about changes to the Rules on the online store website.
Conclusion of a purchase and sale agreement:
2.1 Seller – Margarita Verkauskė, IDV. Well 1310996. The purchase and sale agreement between the Buyer and the Seller is considered concluded when the Buyer forms and submits an order for goods in the online store, having previously familiarized himself with these rules.
Seller’s rights:
3.1 In the event of important circumstances, the Seller may temporarily or completely suspend the operation of the online store without prior notice to the Buyer. 3.2. If the Buyer attempts to undermine the operation, stability and security of the online store or violates his obligations, the Seller has the right to limit or suspend his access to the online store without warning.
Seller’s obligations:
4.1. The Seller undertakes to provide access to the services of the online store, the operating conditions of which are established by these Rules. 4.2. The Seller undertakes to deliver the goods purchased by the Buyer by the delivery method chosen by the Buyer, based on the conditions established by these Rules of Purchase and Sale. 4.3. When, due to unforeseen circumstances, the Seller cannot deliver the goods ordered in the online store, the Seller has the right to terminate the Purchase and Sale Agreement after informing the Buyer in advance. The Seller may offer an analogous product. If the Buyer refuses, the Seller undertakes to refund the money paid within 14 calendar days. 4.4. If the Buyer exercises the right provided for in paragraph 5.2 of the Rules, the Seller undertakes to refund the money paid to the Buyer within 14 calendar days from the date of receipt of the returned goods.
Buyer’s rights:
5.1. The Buyer has the right to purchase goods in the online store in accordance with these Rules. 5.2. The Buyer has the right to withdraw from the contract of sale of goods concluded in the online store by notifying the Seller in writing no later than 14 calendar days from the date of delivery of the goods. 5.3. The Buyer may exercise the Buyer’s right discussed in clause 5.2 only if the goods meet the conditions set out in clause 10.2. 5.4 The Buyer must contact the e-mail address: info@mvfashiongallery.eu regarding the return of the goods. The Buyer will be sent a return form by e-mail, which the Buyer, after filling out, shall submit to the specified e-mail address.
Buyer’s obligations:
6.1. The Buyer must pay for the purchased goods and accept them in accordance with the procedure provided for in these Rules. 6.2. If the Buyer, during the delivery of the goods, refuses to accept the goods from the courier without good reason, upon the Seller’s request, the Buyer must cover the costs of returning the goods. 6.3. During the delivery of the goods to the Buyer, the Buyer must check the condition of the parcel and the goods(s) together with the Courier who delivered the parcel. 6.4. By using the online store, the Buyer confirms that he/she agrees with these purchase-sale-return rules and must comply with them.
Product prices:
7.1. The prices of goods in the online store are indicated in euros. Upon confirmation of the order, the delivery fee, if applicable, is added to the total amount of the goods.
Ordering and paying for goods:
8.1. The Buyer, having visited the online store, selects the goods he likes, which he places in the shopping cart. After creating the shopping cart, the Buyer enters the personal data necessary for the execution of the order: his name, surname, address to which the goods will be delivered, telephone number and additional information that may be important for the delivery of the ordered goods. The Buyer confirms that he has read these rules and confirms the order. 8.2. Payment can be made using the electronic banking services of Lithuanian banks and other payment methods supported by the “Paysera” system. Payments are made in euros.
Delivery of goods:
9.1. When ordering goods, the Buyer must indicate the exact delivery address of the goods. 9.2. The Buyer must accept the goods from the Courier himself. If the Buyer cannot accept the goods himself, but the goods are delivered to the address specified by the Buyer, the Buyer does not have the right to make claims for the delivered goods to the wrong person. 9.3. The goods are delivered to the Buyer within the terms specified in the descriptions of the goods. 9.4. The characteristics of all goods sold are indicated in the description of each item. The Seller is not responsible for the fact that the color, shape or other parameters of the goods in the online store may not correspond to the actual size, shape and color of the goods due to the characteristics of the screen used by the Buyer.
Return of goods:
10.1. Quality goods are returned within 14 calendar days from the date of receipt. Defects in sold poor-quality goods are eliminated, poor-quality goods are replaced, and returned in accordance with the provisions of the Civil Code of the Republic of Lithuania.
10.2. When returning goods, the following conditions must be observed: 10.2.1. The returned goods must be in the original, neat packaging; 10.2.2. The goods must not be damaged by the Buyer; 10.2.3. The goods must be unused and have not lost their commercial appearance: labels are not damaged, protective films are not torn, etc.; 10.2.4. The returned goods must be in the same configuration as the Buyer received them; 10.2.5. The Seller has the right to refuse to accept the goods returned by the Buyer if the conditions for returning the goods were not met; 10.2.6. The return of the goods is carried out in the manner established by the Seller within 14 calendar days from the date of receipt of the goods (this point does not apply in the case when the goods are of poor quality – in such a case, the return of the goods is carried out within the statutory warranty period);
10.3. Return and exchange of goods of suitable quality is carried out in accordance with Part 1 of Article 6.22810 of the Civil Code; 10.4. The money paid for the goods accepted by the Buyer but later refused shall be returned to the Buyer’s account no later than within 14 calendar days from the date of return of the goods to the Seller, unless the Seller and the Buyer agree otherwise. 10.5 If the Buyer withdraws from the purchase and sale agreement, the amount paid for the goods shall be returned to the Buyer. 10.6 The Buyer shall pay the delivery/shipping costs of the goods to the Seller.
Non-returnable items:
11.1 Clause 17 of the Retail Trade Rules provides for a list of non-returnable goods. Goods included in this list, provided they are of suitable quality, may only be returned with the Seller’s consent.
Final provisions:
12.1 These Rules have been drawn up in accordance with the legal acts of the Republic of Lithuania. 12.2. All disagreements arising from the implementation of these Rules shall be resolved through negotiations. If an agreement cannot be reached, disputes shall be resolved in accordance with the procedure established by the laws of the Republic of Lithuania. 12.3. The Parties shall be released from the implementation of their obligations under these Rules if they cannot be fulfilled due to unforeseen circumstances beyond the control of the Parties (Force majeure).
